NFL PLAY 60 CHALLENGE
OFFICIAL RULES
1. Eligibility: The National Football League ("NFL") "NFL PLAY 60 Challenge" (the "Contest") is open to teachers of students in the fourth and fifth grades during the 2009 – 2010 school year, ("Teachers") of students attending schools in Miami-Dade, Broward, and Palm Beach counties in the State of Florida at time of entry. Employees of NFL, NFL Properties LLC, NFL Ventures, L. P., its Member Clubs (collectively the "NFL Entities"), the American Heart Association, and each of their respective affiliates, officers, directors, and agents and all their respective subsidiaries, affiliates, retailers, parents, advertising and promotion agencies, and their immediate family members or persons living in the same household (whether related or not) are ineligible to participate. The Contest is subject to all federal, state, and local laws and regulations. Void where restricted or prohibited by law.
2. Sponsor and Administrator: The sponsors of this Contest are the National Football League, 280 Park Avenue, New York, NY 10017, and the American Heart Association, 7272 Greenville Avenue, Dallas, TX 75231, (collectively, the "Sponsor").
3. Agreement to Official Rules: By participating in this Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the judges (the "Judges") who meet the following requirements: 1) Submit contest entry form; 2) Submit completed Classroom Scoreboard. All decisions on entries will be made in the Judges' sole discretion and will be final and binding. If an entrant violates or fails to follow any of these Official Rules, that entrant will be disqualified. The decisions of the Sponsor and Judges are final.
4. Timing: The Contest begins at 12:01 p.m., Eastern Standard Time, October 24th and ends at 11:59 p.m., Eastern Standard Time, on December 14, 2009 (the "Contest Period"). Electronic entries must be received by the end of the Contest Period. Mailed entries must be postmarked by the end of the Contest Period and received no later than 11:59 p.m., Eastern Standard Time, on December 30, 2009.
5. How to Enter: NO PURCHASE IS NECESSARY TO ENTER OR WIN. Go to www.americanheart.org/superbowlchallenge and follow the links and instructions for entering the Contest. Teachers may submit their Contest entry using the online entry form or paper entry form. Paper entry forms must be sent via the U.S. Postal Service to "NFL PLAY 60 Challenge" Attn: Chase Beck, 280 Park Avenue, 17W, New York, NY 10017. Entries may also be faxed to 212-847-1857, or scanned and e-mailed to NFLPlay60@nfl.com. All entries must be submitted in English. All entries must be submitted on the official paper entry form or through the electronic entry form. No other paper, facsimile, or electronic entries will be considered. The Sponsor is not responsible for lost, late, stolen, delayed, destroyed, misdirected, illegible, or incomplete entries. Any use of mechanical, robotic, repetitive, automatic, programmed, or similar entry methods or agents is prohibited. Limit one entry per person (online or paper). All entries become the property of the Sponsor and will not be returned. Except as otherwise provided herein, information collected from the entrant is used only for the purpose of administering the Contest, such as to notify a potential winner, and publicizing the Contest, such as posting entries on a website publicizing the event. The entrant’s personal information will not be sold or shared with any other party and will not be used for marketing purposes by the Sponsor. Entries must include contest entry form and “Classroom Scoreboard” which includes how many minutes of physical activity their students achieved over the course of the NFL PLAY 60 Challenge.
6. Selection of Winners: All decisions of the Judges will be made in their discretion and are final. The Judges will randomly select at least 8contest entries from each of the following counties: Miami-Dade, Broward and Palm Beach that represent the 4th and 5th grade. The opinions of the Judges will remain confidential and will not be made available to entrants, the media, or any party other than those involved with the judging and administration of the Contest. The potential winning Teachers and Teachers' schools will be notified by phone.
An entrant identified as a potential winner has not won the Contest unless and until: (i) entrant’s eligibility has been verified; (ii) entrant and each individual represented in any submission has signed and returned all releases, forms, and agreements related to their participation in the Contest; (iii) entrant’s school has signed and returned all releases, forms, and agreements related to the acceptance of their prizes; (iv) entrant has been notified that verification is complete and all required releases, forms, and agreements have been signed and returned to the Sponsor; and (v) Teacher’s school or school board will agree to be responsible for busing winning classes to the event.
If a potential winner cannot be contacted within five business days, an alternate potential winner will be chosen. An alternate potential winner will also be chosen if a potential winner or his or her school refuses a prize or fails to sign and return all releases, forms, and agreements related to the acceptance of a prize, including a publicity release, where not prohibited by law, within five business days of receipt of those documents from the Sponsor.
7. Prizes: All prizes will be awarded as follows:
a. One (1) classroom within a sixty (60) mile radius of Dolphin Stadium will receive an NFL player school visit during the week leading up to Super Bowl XLIV, an invitation to attend Kids’ Day at Super Bowl XLIV Fan Plaza. Estimated total retail value $1,500.
b. 8 classrooms from the above referenced counties will receive a trip to attend Kids’ Day at Super Bowl XLIV Fan Plaza. Total estimated retail value $1,000.
c. At least 3 classrooms will be eligible to win a $2,500 monetary grant donation from NFL Charities and the American Heart Association for their school. The grant must be used to purchase new athletic equipment or allocated toward in-school or after-school health and fitness programming.
d. One (1) classroom will receive tickets to attend the NFL Pro Bowl game to be played on January 31, 2009 at Dolphin Stadium. Up to 30 students will be provided two tickets for themselves and a guardian and two tickets will be provided for the teacher for a total of sixty-two (62) tickets.
All potential winning entries are subject to verification
by Sponsor. Sponsor's decisions are final and binding in all
matters related to the Contest.
All awards are non-refundable, non-redeemable, and non-transferable; no substitutions or cash equivalents allowed except by the Sponsor who reserves the right to award a prize of comparable or greater value if advertised prize is unavailable.
ALL TAXES, FEES, AND ANY INCIDENTALS AND OTHER EXPENSES NOT SPECIFIED HEREIN ASSOCIATED WITH A PRIZE AND ITS RECEIPT, INCLUDING, WITHOUT LIMITATION TO, INCOME TAXES, ARE THE SOLE RESPONSIBILITY OF THE RECIPIENTS.
8. Publicity: Except where prohibited by law, participation in the Contest constitutes each entrant’s consent to Sponsor’s use of each entrant’s first name, age, hometown, and state for administrative and promotional purposes related to the Contest in any media now known or later developed, in perpetuity, without further payment or consideration. Each entrant grants Sponsor permission to publish, distribute, or otherwise make known to the general public the contents of their Contest entry. Potential winners will be required to execute a publicity release entitling the Sponsor to use the entrant’s name, likeness, voice, opinions, biographical information, hometown, and state for promotional, commercial, or other purposes in any media now known or later developed, in perpetuity, without further payment or consideration.
9. Release and Indemnification: Each entrant hereby releases any claim against, agrees to hold harmless, and agrees to defend and indemnify Sponsor and/or the Judges, their respective advertising and promotion agencies, and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, licensees, agents, successors, assigns, and each of their respective employees, officers, agents, representatives and directors, and all others connected with the Contest from any and all liabilities, claims, actions, damages, harm, injury, expenses, and losses (including, without limitation, attorneys’ fees) of any kind or nature whatsoever in any way caused by or arising out of entrant’s participation in the Contest, including, without limitation, property damage, personal injury, and/or death which may occur in connection with, preparation for, travel to, or participation in the Contest, or possession, acceptance, and/or use or misuse of prize or participation in any Contest-related activity, or any claims, including third-party claims, based on publicity rights, defamation, invasion of privacy, copyright law, trademark law, patent, or merchandise delivery.
10. General Conditions: Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures, mistake, virus, bug, or other cause beyond the reasonable control of the Sponsor impairs the integrity, security, or proper administration of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any entrant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Limitations of Liability: In no event shall the Sponsor, their respective affiliates and related companies, or their respective officers, directors, employees, or agents collectively herein be liable for: (i) entries not received due to or ineligible because of incomplete, unclear, indecipherable, or inaccurate information, delayed or failed network connections, or other mechanical or technical problems, however caused, including a busy phone signal; (ii) any failure of the website or features on the website during the Contest Period, or for any problems with using the website, including the failure to have cookies enabled, or mechanical or technical malfunction of, or damage to, any telephone network or lines, computer online systems, servers, access providers, computer equipment, software; for failure of any email or entry to be received by Sponsor for any reason, including on account of human error or mechanical or technical problems or traffic congestion on the internet or at any website, or any combination thereof; for damage to an entrant’s or any other person’s computer or for breaches of privacy due to interference by third-party computer “hackers” or viruses, bugs or other problems, technical failures of any kind, including, but not limited to, the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries; or (vi) any injury, loss, claim, damage, or special, punitive, indirect, incidental, or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, to persons or property, including, but not limited to, entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or that arise out of or are in any way connected with the use, or the inability to use, the NFLRUSH.com websites or the services or materials on the site, even if advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages so the above limitation or exclusion may not apply to you. The entrant’s use of the site shall be at the entrant’s own risk.
12. Disputes: Entrant agrees that: (i) where not prohibited by law, any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the courts of the State of Florida and the United States District Court of Florida thereto in respect to any controversy which may arise out of or in relation to this agreement or its performance and each party hereby waives any objections to such jurisdiction and venue; and (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event may entrant be entitled to claim punitive, incidental, or consequential damages, or attorneys’ fees, and entrant hereby waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
13. Winners List: A list of the winning schools may be obtained after January 30, 2010, and no later than February 28, 2010, by sending a self-addressed, stamped envelope to: NFL PLAY 60 Challenge, Attn: Chase Beck, 280 Park Avenue, 17W, New York, NY 10017. The names of the winning schools will also be posted on www.americanheart.org/SuperBowlChallenge.com during this time period.
